Terms of Service

Last updated: July 2026

These Terms of Service govern your use of the websites, mobile applications and related digital services operated on the CursusX Platform, including encirkl.

By accessing or using a covered service, you agree to these Terms. If you do not agree, you must not use the service.

Important: These Terms regulate use of the services. Information about personal data is provided separately in our Privacy Policy.

1. Provider

The services are operated by:

Marian Kulisch
CursusX Platform
Republic of Korea
Email: contact@cursusx.de

Further provider information is available in the Imprint.

2. Scope of the Services

CursusX provides digital platforms, websites, mobile applications and related services for communities, organizations, businesses and public initiatives.

encirkl is the first public application built on the CursusX Platform. Additional applications, websites or services may be introduced in the future.

Specific features, participation rules or partner conditions may be displayed within an individual service. Where such specific conditions conflict with these Terms, the more specific conditions apply to the relevant feature or offer.

3. Eligibility and Use by Minors

You may use the services only if you are legally permitted to do so under the laws applicable to you.

Users under the age required to consent independently must use the services only with permission and supervision from a parent or legal guardian.

Parents and legal guardians are responsible for the use of the services by minors under their supervision.

4. User Identification and Access

Some services may be used without a traditional user account. Other services, including partner or administration areas, may require registration, login credentials or another form of access authorization.

You are responsible for keeping access credentials and recovery information secure. You must not share protected access with unauthorized persons.

You must provide accurate information where information is required for a service, challenge, reward or partner function.

5. Community Features

Applications on the CursusX Platform may offer community features such as public loops, challenges, rankings, achievements, profiles or other shared results.

Public features may be visible to other users, partners or visitors. Before publishing information, you are responsible for checking whether you are comfortable making it public.

Participation in community features is voluntary unless expressly stated otherwise.

6. Challenges, Rewards and Partner Offers

Businesses, organizations, communities or other participating partners may provide challenges, rewards, benefits, events or other offers through the platform.

Additional conditions may apply to an individual offer, including eligibility requirements, availability periods, redemption limits, location restrictions or other participation rules.

Unless expressly stated otherwise, rewards and partner offers are provided by the respective partner. CursusX does not guarantee that a partner offer will remain available, be suitable for a particular purpose or be accepted after its stated validity period.

Rewards, benefits and offers have no cash value unless expressly stated. They may not be transferred, resold, duplicated or manipulated.

7. User Responsibilities

You are responsible for your own conduct and for complying with applicable laws, local rules and third-party rights while using the services.

In particular, you must:

The services do not replace your own judgment. You remain responsible for deciding whether an activity, route, place or offer is safe and appropriate for you.

8. Acceptable Use

You must not misuse the services. Prohibited conduct includes:

9. Public Content and User Contributions

You retain ownership of content that you create and submit, subject to the rights needed to operate the service.

When you choose to publish content through a service, you grant the Provider a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format and distribute that content solely as necessary to operate, secure, improve and present the relevant service.

This licence ends when the content is deleted from the service, except where continued retention is legally required, technically unavoidable for a limited period, or necessary to protect legitimate rights and platform integrity.

You confirm that you have the necessary rights to publish submitted content and that it does not violate applicable law or third-party rights.

The Provider may remove or restrict content that violates these Terms, applicable law or the rights and safety of others.

10. Intellectual Property

The services, software, visual design, logos, names, text, graphics and other materials supplied by the Provider are protected by applicable intellectual-property laws.

These Terms give you a limited, revocable, non-exclusive and non-transferable right to use the services for their intended purpose. No ownership rights are transferred to you.

You must not copy, modify, distribute, sell, license, reverse engineer or create derivative works from protected parts of the services except where such restriction is prohibited by mandatory law or where prior written permission has been granted.

11. Third-Party Services

The services may contain links to, integrations with or content from third parties, including map providers, app stores, partner websites, social networks or payment and communication services.

Third-party services are governed by their own terms and privacy policies. The Provider does not control and is not responsible for their availability, content, security or conduct.

12. Service Availability and Changes

The Provider aims to keep the services available but does not guarantee uninterrupted, error-free or permanent availability.

Services or individual features may be changed, suspended, restricted or discontinued for operational, security, legal, economic or technical reasons.

Maintenance, updates, external outages, partner decisions or events beyond the Provider's reasonable control may temporarily affect availability.

13. No Medical, Fitness, Safety or Professional Advice

The services provide digital community and activity-related functions. They do not provide medical, health, fitness, navigation, legal or other professional advice.

You should consider your personal health, ability, surroundings and local conditions before participating in any activity. Seek qualified professional advice where appropriate.

In an emergency, contact the appropriate local emergency service.

14. Disclaimer of Warranties

To the extent permitted by applicable law, the services are provided on an "as available" basis.

The Provider does not guarantee that information, public content, rankings, challenges, partner offers or third-party materials are complete, accurate, current, suitable or continuously available.

Mandatory consumer rights and statutory warranties remain unaffected.

15. Limitation of Liability

The Provider is liable without limitation where liability cannot legally be excluded or limited, including liability for intent, gross negligence, injury to life, body or health, and mandatory statutory liability.

For ordinary negligence, the Provider is liable only for breach of an essential contractual obligation and only for the foreseeable damage typical for this type of agreement, to the extent permitted by applicable law.

The Provider is not responsible for user conduct, third-party content, partner performance, unsafe environments, unauthorized access caused by the user's failure to secure credentials, or events outside the Provider's reasonable control.

Nothing in these Terms limits rights that cannot be limited under applicable consumer-protection law.

16. Suspension and Termination

You may stop using the services at any time.

The Provider may restrict, suspend or terminate access where there is a reasonable belief that a user has violated these Terms, applicable law, third-party rights, security requirements or specific participation rules.

Where appropriate and legally required, the Provider will consider the nature, seriousness, frequency and consequences of the conduct before taking action.

Provisions that by their nature should survive termination remain effective, including provisions on intellectual property, liability and dispute resolution.

17. Privacy

Personal data is processed as described in the applicable Privacy Policy. The Privacy Policy forms a separate document and does not replace these Terms.

18. Changes to these Terms

The Provider may update these Terms to reflect changes in law, services, security requirements or business operations.

The current version will be published on the CursusX websites. Where required by law or where changes materially affect users, reasonable notice will be provided.

Continued use after an updated version takes effect constitutes acceptance only where permitted by applicable law.

19. Governing Law and Consumer Rights

These Terms are governed by the laws applicable at the Provider's place of establishment, unless mandatory consumer-protection rules in the user's country provide otherwise.

If you are a consumer, you retain the protection of mandatory provisions of the law of the country in which you have your habitual residence where applicable.

Any mandatory rights regarding competent courts and dispute resolution remain unaffected.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be replaced, where legally permissible, by a valid provision that most closely reflects its purpose.
